Alas, they only learn about it after receiving a large fine. But do not worry, the ban on visiting the forest while driving a car does not always apply. So is it possible to enter the forest by car or not? Unfortunately, there is no definite answer to this question. Remember, we are not in Europe or the United States, where there are much less contradictions in the current legislation. Everything is, as always, confusing and vague. The thing is that the movement of vehicles in the forest is regulated by more than one federal law. As a result, it all depends on which forest you want to enter, in which region, as well as on whether there are restrictions on citizens visiting the forests and a complete ban on entering the forest for any transport in connection with the area where the forest is located. with an unfavorable fire situation.

The worst thing is that, according to the current legislation, ignorance of the law in our country does not exempt from responsibility. So if you break the law out of ignorance and enter the forest when it is prohibited, you run the risk of running into a large fine.

So, in what cases does the law directly prohibit the movement of vehicles in the forest? Let's go in order.

According to the state authorities, local authorities, within the limits of their powers, have the right to impose restrictions on the stay of citizens in the forests and the entry of vehicles into them in order to ensure fire safety in the forests.

That is, local authorities can at any time, in connection with an unfavorable fire situation, impose a ban on the entry of cars into the forest (into the forest).

For example, each district or region of the Russian Federation can, at its discretion, introduce a temporary ban on the entry of vehicles into the forest. If you drive a car into a forest in an area where the ban is in force, then you break the law and you can be brought to administrative responsibility under Article 8.32 of the Administrative Code of the Russian Federation (Violation of fire safety rules in forests). Depending on the type of violation, Article 8.32 of the Code of Administrative Offenses of the Russian Federation provides for a fine in the amount of 1,000 to 5,000 rubles.

According to part 3 of the same article 8.32 of the Administrative Code, violation of fire safety rules in forests in a special fire safety regime entails the imposition of a fine in the amount of 4,000 to 5,000 rubles (a fine for citizens - individuals).

If the offender turns out to be an official, the fine will be from

20,000 to 40,000 rubles. A legal entity will have to pay from 300,000 to 500,000 rubles for non-compliance with the rules.

So, before going into the forest, check in advance if there is a special fire safety regime in the area where the forest is located, in which the authorities of the region / district temporarily restrict the movement of any transport in the forest.

Unfortunately, many municipalities, in order to be on the safe side, usually without thinking twice, introduce similar bans on vehicles entering the forest with the onset of spring and until the onset of autumn. As a result, all summer in many forests of Russia there is a ban on the movement of cars. And, as you can see, the fact that you do not know about it will not exempt you from a large fine.

The commented article 11 of the Forest Code regulates the procedure for citizens' stay in forests both on the lands of the forest fund and on lands of other categories, including the rights and obligations of citizens. The rights include the right of citizens to freely stay in the forests. It is practically a public forest servitude or general forest use that does not require special permits. The only condition for the free and free stay of citizens in the forests is to stay and harvest and collect forest resources only for their own needs.

The law establishes the possibility for citizens to collect both food forest resources: wild fruits, berries, nuts, other edible forest resources, and non-timber forest resources. As you can see, the new edition of the RF LC, in addition to food forest resources, also establishes the collection of non-timber forest resources by citizens for their own needs without permits.

The Code, like its previous version, prohibits the harvesting and collection of mushrooms and wild plants listed in the Red Data Books of the Russian Federation or its subjects, as well as those recognized as narcotic drugs in accordance with the Federal Law "On Narcotic Drugs and Psychotropic Substances." Today in the Russian Federation the Federal Law of December 21, 1994 No.N 69-FZ "On fire safety" (as amended on December 18, 2006), as well as the Fire safety rules in the forests of the Russian Federation, adopted by the Council of Ministers - the Government of the Russian Federation by Resolution of September 9, 1993 N 886, as amended. RULES OF BEHAVIOR IN THE FOREST
